I'd say the answer is no. I would say they spoke on the phone. But that he told me the bad news over the phone.
My advice is that we use 'on the phone,' normally and 'over the phone' when we want to talk about the telephone as a method of communication. I like spy novels, and the characters in the spy novels are always saying things like "we can't talk about this over the phone," referring to the phone as a 'channel' for communication.
